Re: Official Letter 155/2023/CVM/SEP/GEA-1
- Braskem - Request for clarification on media report
Dear Sirs,
We refer to Official
Letter 155/2023/CVM/SEP/GEA-1 ("Official Letter"), dated May 15, 2023, in which you requested clarifications from Braskem S.A.
("Braskem" or "Company"), as transcribed below:
“Dear
Sirs,
1.
We refer to news reports published on May 12, 2023, in the O Globo news portal entitled: "Alagoas Court orders Braskem to increase
guarantee insurance of R$1.1 billion under penalty of new blocking", informing the following:
The Court of Justice
of Alagoas (TJ-AL) determined that Braskem complements by 30% the guarantee insurance stipulated to suspend the blocking of approximately
R$1.1 billion in its accounts.
The obstruction had
been imposed to ensure the payment of compensation to the state due to the damage caused by the sinking of the soil in Maceió,
a result of the petrochemical company salt mining. However, the effects of the decision were suspended at the end of April upon the presentation
of a guarantee insurance of the same value.
Now, Judge Elisabeth
Nascimento partially accepted an appeal from the Alagoas government and gave Braskem 15 days to add to the billionaire amount another
30% of the amount, that is, approximately R$330 million. If it does not comply, the company may have its assets blocked again.
2.
In view of the above, we request a statement from the Company about the veracity of the report and, if it is, explain why the Company
believed this was not a Material Fact and also provide any other
information deemed important on the subject.”
1
In this regard,
Braskem informs that it was only notified on May 15, 2023, of the decision to supplement the 30% guarantee insurance, whose value is not
material for the Company, but it will evaluate and take the appropriate measures within the applicable legal deadlines and will keep the
market informed on any relevant developments on the matter.
Being
what we had for the moment, we subscribe, making ourselves available for further clarifications if necessary.
São Paulo, May 16, 2023.
